Regulations for the provision of services by electronic means

§ 1.
The terms used in the Regulations mean:
- Working days – days from Monday to Friday, excluding public holidays.
- Customer – a natural person who has the capacity to perform legal acts, a legal person, or an organizational unit that is not a legal person, to which separate regulations grant legal capacity, placing an Order within the Online Store. In the event of conclusion of the Agreement by a person with limited legal capacity, it is necessary to confirm the Agreement in writing by the legal representative of that person.
- Civil Code – Act of 23 April 1964 (Journal of Laws of 2018, item 1025, as amended)
- Account – a part of the Online Store assigned to a given Customer, by means of which the Customer may perform specific actions within the Online Store.
- Product – a service or an intangible product (audiobook, report, opinion, etc.) available in the Online Store, which is the subject of the Agreement between the Client and the Operator
- Regulations – these Regulations for the provision of services by electronic means.
- Registration – a one-time action consisting in the creation of an Account by the Customer, performed using the Registration Form provided by the Seller on the website of the Online Store.
- Registration Form – a form available in the Online Store enabling the creation of an Account.
- Online Store – the Seller's website available at jbsolutions.pl
- Operator – JB Solutions sp. z o. o. with its registered office in Gdańsk, ul. Jana z Kolna 11, 80-864.
- Agreement – a Product sales agreement or a service provision agreement concluded via the Online Store between the Operator and the Customer.
- Consumer Rights Act – Act of 30 May 2014 (Journal of Laws of 2017, item 683, as amended).
- Order – declaration of will of the Customer, aimed directly at concluding the Agreement, specifying in particular the type and number of Products
- Order Form – an interactive form available in the Online Store, enabling the placement of an Order, in particular by adding Products to the electronic basket and specifying the terms of the Agreement, including the method of delivery and payment.
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), together with generally applicable provisions of Polish law regarding the protection of personal data.
- Privacy Policy – a document related to the Regulations, placed on the website to inform users about the principles of processing personal data, containing information on cookies and the purposes for which they are used and the method of securing data collected from users.
§2.
- To use the Online Store, in particular to make purchases in the Online Store, the Customer must have:
- Internet access;
- standard operating system;
- standard web browser;
- active e-mail address.
- Using the Online Store means any action by the Customer that leads to him/her becoming familiar with the content contained in the Online Store.
- In particular, the Customer is prohibited from:
- using the Online Store in a way that disrupts its functioning;
- using the Online Store in a manner that is burdensome to other Customers and the Operator;
- using the Online Store in a manner inconsistent with the provisions of the law in force in the territory of the Republic of Poland and the provisions of the Regulations;
- disseminating or posting unsolicited commercial information within the Online Store.
- The prices of the Products given on the Online Store website are gross prices. The prices of the Products may change as a result of a promotional campaign or sale conducted by the Seller, provided, however, that the terms of the Order are not changed in relation to the Customer who placed the Order before the commencement of the promotional campaign or sale.
- In the case of ordering a service that is priced individually, the Client will receive a quote immediately (assuming that the description of the actual situation is sent on working days between 8:00 and 15:00).
- The products offered in the Online Store are free from legal defects. The operating parameters of the Products and their prices provided on the Online Store website constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
§3.
- Placing an Order by the Customer for a Product available in the Online Store constitutes an offer to the Operator to conclude an Agreement for this Product.
- In the case of an individually priced service, the Customer who has accepted the price quote places an order in accordance with paragraph 4.
- The customer can place an order as a guest.
- To place an Order, the Customer is obliged to take the following steps:
- select the Product by clicking the "Buy Now" button;
- indicate the method of delivery and payment;
- click the "Proceed to checkout" button,
- select the option "Shopping without registration",
- provide the address for shipping the Order and the data for the purchase document.
- read the Regulations and Privacy Policy and accept them. By accepting them, the Customer confirms that he/she has read their content. Acceptance of the Regulations and Privacy Policy is voluntary, but necessary to place an Order,
- click the "Place Order" button.
- If the Customer has chosen to pay for the order via the PayU service, after clicking the "Place an order" button, the Customer will be redirected to the PayU transaction page to make payment for the Order.
- After placing the Order, the Customer will receive an e-mail confirming receipt of the Order and containing confirmation of the essential elements of the Order. The above e-mail constitutes the Operator's declaration of acceptance of the offer and upon its receipt by the Customer, an Agreement is concluded between the Operator and the Customer.
§4.
- The Customer may pay the price under the Sales Agreement in the following manner:
- via the PayU service – in accordance with the service regulations available at http://www.payu.pl ;
- by traditional transfer to the bank account maintained by mBank, account number: 80 1140 2004 0000 3502 7511 8323.
- If the Customer has chosen the payment method in the form of a traditional transfer or via the PayU service, they are obliged to make the payment within 3 days from the date of conclusion of the Agreement. After this period has elapsed without effect, the Order will be canceled. The day of payment is considered to be the day on which the bank account to which the payment was made is credited.
- The Customer bears the costs of delivery of the Product. The costs of delivery and possible forms of delivery are indicated to the Customer when placing the Order.
§5.
- The execution of the Order begins after the Operator sends the Customer an e-mail containing confirmation of acceptance of the Order.
- The Order processing time is counted from the date of payment for the Order,
- After completing the Order, the Operator will send a confirmation of order completion and the completed order to the Customer's e-mail address.
- The Order will be fulfilled within 7 Business Days from the date of payment by the Customer.
- The Operator reserves the right to withdraw from the execution of the Order if the import of the Product would be impossible, would involve excessive costs or a long waiting period. In such a case, the Operator will notify the Customer of the above and will return the paid amount within 14 days from the date of sending this information to the Customer.
§6.
- In accordance with art. 38 point 13 of the Act of 30 May 2014 on consumer rights, the Customer who is a Consumer within the meaning of the Civil Code Act, is not entitled to withdraw from a distance sales contract in relation to contracts for the supply of digital content that is not recorded on a tangible medium, if the performance of the service has begun with the express consent of the Consumer, before the deadline for withdrawal from the contract expires and after the Operator has informed him of the loss of the right to withdraw from the contract.
- In other cases, not covered by paragraph 1 of this § 6, the Customer who is a Consumer has the right to withdraw from the contract for the provision of services without giving reasons, within 14 calendar days from the date of its conclusion. To meet the deadline, it is sufficient to send the declaration before the deadline expires.
- Withdrawal is made by submitting a written declaration of withdrawal from the contract sent to the Operator by e-mail to the following address: kontakt@jbsolutions.pl
- The Operator shall immediately send the Consumer a confirmation of receipt of the declaration of intent to withdraw from the sales contract to the e-mail address indicated by the Consumer.
- The right to withdraw from a contract for the provision of services concluded at a distance, referred to in paragraph 2, does not apply to the Consumer in relation to contracts:
- for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has performed the service he will lose the right to withdraw from the contract;
- in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires;
- where the subject of the performance are things that after delivery, due to their nature, are inseparably connected with other things;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription agreements;
- for the supply of digital content that is not recorded on a tangible medium, if the performance of the service has begun with the express consent of the consumer before the expiry of the deadline for withdrawal from the contract and after the entrepreneur has informed the consumer of the loss of the right to withdraw from the contract.
- The Operator, no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the contract, will return all payments made by the Consumer. The Operator shall return the payment using the same method of payment that the Consumer used, unless the consumer has expressly agreed to another method of return that does not involve any costs for him.
§7.
- The Operator shall not be liable for any consequences resulting from the use of information posted on the website or the use of templates of documents provided as part of the services.
- The Operator shall not be liable for any property or non-property damage incurred by the Customer as a result of using the services provided by the Online Store, unless they were caused intentionally by the Service Provider or these Regulations provide otherwise.
§8.
- All complaints should be submitted electronically by filling out the complaint form, available after sending the information to the following address: kontakt@jbsolutions.pl
- Complaints will be considered within 7 business days.
- The response to the complaint is sent to the Customer's e-mail address.
§9.
- The Operator's liability for failure to perform or improper performance of a service provided under an agreement concluded with the Client is limited to the amount of remuneration paid by the Client for the service provided.
- The limitation set out in paragraph 1 does not apply to:
- consumers;
- cases in which limitation of liability is impossible by law.
§10.

- The provision of personal data by the Customer is voluntary, but necessary to complete the order.
- The customer is responsible for providing false personal data.
- Personal data of Participants, within the scope specified in the Regulations, will be processed by the Administrator in accordance with the provisions of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended).
- The Customer's personal data will be processed for the purpose of communication between the Seller
and the Customer, as well as for the purpose of executing the Sales Agreement and delivering and paying for the Product. - If the Customer gives additional consent, personal data will be processed by the Seller in order to inform the Customer about new promotions and services.
- The Customer has the right to access the content of the data and to rectify, delete or limit its processing, as well as the right to object, demand the cessation of processing and transfer of data, as well as the right to withdraw consent at any time and the right to lodge a complaint with the supervisory authority (i.e. the President of the Office for Personal Data Protection).
- Data provided by the Client will not be subject to disclosure to third parties. The recipients of the data will only be institutions authorized by law.
- Data provided by the Client will not be subject to profiling.
- The data controller has no intention of transferring personal data to a third country or an international organisation.
- Personal data will be stored for a period of 10 years, counted from the beginning of the year following the year in which consent to the processing of personal data was given.
The principles of processing personal data by the Administrator are specified in the Security Policy, which also contains information on the use of cookies and the use of marketing tools for this purpose, including Facebook Lead Ads and Google Analytics.
§11.
- The Regulations constitute an integral part of the Sales Agreement concluded between the Customer and the Seller.
- The Regulations come into force on the date of publication on the Online Store website.
- The Operator reserves the right to change the Regulations. For contracts concluded before the change of the Regulations, the version of the Regulations in force on the date of conclusion of the contract shall apply.
- In matters not regulated in the Regulations, the provisions of the Civil Code or other acts applicable to the activity and functioning of the Online Store in accordance with Polish law shall apply accordingly.
- All photos, graphics, logos, publications and texts available in the Online Store are protected by the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 1994, No. 24, item 83). Unlawful copying, reproduction or distribution of any content contained on the Online Store website is prohibited.
